The following, as amended or updated from time to time, constitute the terms and conditions of Models Connect LTD Registered Limited Company in England 05677754(the Terms, each a Term).
By using Models Connect you agree to be legally bound by these Terms, which shall take effect immediately on your first use of Models Connect and to respect them at all times. If for any reason whatsoever, you do not agree to or cannot be legally bound by all the following Terms you must immediately cease use of and/or cease accessing Models Connect.
By agreeing to these Terms you confirm that all personal information provided by you is correct and true.

About Models Connect
Models Connect Ltd is an employment agency in the understanding of the Section 13(2) of the Employment Agencies Act: business of providing services, whether by the provision of information or otherwise for the purpose of finding models employment by allowing the facility for employers - agencies - to contact those models in order to provide work.
However Models Connect Ltd does not actively seek work for members, only gives access to modelling and casting agencies to use the website and search for new faces. Models Connect Ltd does not guarantee contracts or work with registered agencies, does not charge commission on any contract signed or work provided by agencies.
Models Connect Ltd charges website fee for the space used by uploaded photos. Models Connect Ltd also provides other services, such as advice and information on modelling, modelling industry and established agencies, recommend professional photographic services. Photographic services are not conditional for the website membership.
General Terms
Governing
Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the
laws of
Severability
Part or all of any of these Terms that is illegal or unenforceable may
be
severed from these Terms and the remaining Terms shall continue in
force.
Waiver
Models Connect shall not be deemed to have waived any of its rights
under these
Terms unless that waiver is in writing and signed by Models Connect.
The
failure of Models Connect to insist upon the strict observance of any
of these
Terms, or to exercise any rights in respect thereof shall not be
construed as a
waiver of that Term or Terms.
Amendments
Models Connect may amend any or all of these Terms in any respect and
at any
time by posting changes online. Please review these Terms regularly to
ensure
you are aware of any changes made by Models Connect. Your continued use
of
Models Connect after changes are posted means you agree to be legally
bound by
these Terms as updated and/or amended.
Entire
Agreement
These Terms contain the entire agreement between you and Models Connect
with
respect to the subject matter hereof and supersedes any and all prior
understandings,
representations, correspondence, arrangements and agreements, oral or
written,
between you and Models Connect.
Your Obligations
Use
of Models Connect
You agree to use this site only for lawful purposes, and in a manner
which does
not infringe the rights of, or restrict or inhibit the use and
enjoyment of
this site by any third party, such restriction or inhibition includes,
without
limitation, conduct which is unlawful, or which may harass or cause
distress or
inconvenience to any person and the transmission of obscene or
offensive
content or disruption of normal service of this site.
You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use Models Connect content in any way except with the prior express consent of Models Connect. You also agree not to adapt, alter or create a derivative work from any Models Connect content without the prior consent of Models Connect.
Accuracy
of Information Provided
You warrant that you will provide accurate
information, including (without limitation) for the purposes of
establishing,
updating and maintaining your personal webpage, when it is requested
by, or
supplied to Models Connect. In all instances we may request a photocopy
of a
passport, national identity card or driving license for identification
purposes.
Parental
Consent
You warrant that, if you are 16 years of age or under, that you have
your
parent(s)/legal guardian´s consent to use Models Connect, and to agree
to these
Terms. You further warrant that your parent(s)/legal guardian agrees to
stand
in your stead to meet any liabilities that you may incur pursuant to
these
Terms.
Observance
of Relevant Law
You warrant that you will, in relation to Models Connect, act in
accordance
with all relevant laws and not use Models Connect for any illegal
purpose at
any time. This includes, without limitation, the Data Protection Act
1998 and
all EU directives and standard regulations related to data protection.
Account
Security
You are strictly liable for the security of your allocated user name
and
password and as such any action associated with that associated user
name will
be deemed to be taken by you personally.
Indemnity
You will indemnify and keep harmless Models Connect against any and all
claims,
damage, loss or costs that may be made against Models Connect, or that
Models
Connect may incur or suffer as a result of your use of Models Connect.
This
indemnity includes, without limitation, claims, damage, loss or demands
made in
relation to your infringement of any third party´s intellectual
property
rights, and any defamatory or negligent activity you undertake.
This section "Indemnity" survives the termination or expiration of the agreement formed pursuant to these Terms.
Intellectual
Property
When you submit any contribution to Models Connect (including any text,
photographs, graphics, video or audio) you agree, by submitting your
contribution, to grant Models Connect a perpetual, royalty-free,
non-exclusive,
assignable and sub-licenseable right and license to use, reproduce,
modify,
adapt, publish, translate, create derivative works from, distribute,
perform,
play, make available to the public, and exercise all copyright and
publicity
rights with respect to your contribution worldwide and/or to
incorporate your
contribution in other works in any media now known or later developed
for the
full term of any rights that may exist in your contribution, and in
accordance
with privacy restrictions set out in the Models Connect´s privacy
policy stated
below. If you do not wish to grant Models Connect the above rights in
respect
of any contribution, please do not submit your contribution to Models
Connect.
This section "Intellectual Property" survives the termination or expiration of the agreement formed pursuant to these Terms.
Moral
Rights
When you submit any contribution to Models Connect (including any text,
photographs, graphics, video or audio) you agree, by submitting your
contribution, to waive any moral rights in such contribution for the
purposes
of its submission to and inclusion on and publication by Models Connect.
Fees
and Overdue Payment
You are responsible for paying any fees that you may owe Models
Connect. Late
payment charges will be shown exclusive of VAT for which you will be
additionally
charged. If payment is not made on the date it is due, Models Connect
is
entitled, without prejudice to any other rights it may have, to charge
interest
on the outstanding balance at the rate of 3 percent above the overnight
rate
set the time by the Royal Bank Of Scotland from the due date until the
outstanding balance is paid in full.
Terminating
Your Account
You can request, in writing, that your
membership of Models Connect be terminated at any time. Please write
"Membership Cancellation" on the envelope in order to speed up the
processing of your request.
This
request will be effective once written notice
is received at Models Connect´s postal address (
Correspondence
and Notices
All correspondence with Models Connect must state your name, contact
phone
number, address, Models Connect user name and e-mail address.
Models Connect Rights and Obligations
Limitation
of Liability
Models Connect content, including but not limited to, the information,
names,
images, pictures, logos and icons regarding or relating to Models
Connect
and/or its products and services (or to third party products and
services)
and/or any Models Connect user, is provided "AS IS" and on an
"IS AVAILABLE" basis without any representations or any kind of
warranty made (whether express or implied by law) to the extent
permitted by
law, including the implied warranties of satisfactory quality, fitness
for a
particular purpose, non-infringement, compatibility, security and
accuracy. You
will not be entitled to any compensation for any period during which
Models
Connect is inaccessible.
To the maximum extent permitted by statute, Models Connect will not, under any circumstances, be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise): (a) loss of data (including any pictures or contributions provided by you); (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of Models Connect regardless of the form of action.
Models Connect does not make any warranty or representation that the functions contained in Models Connect content will be uninterrupted or error free, that any defects will be corrected, or that Models Connect or the server that makes it available are free of viruses or bugs.
This section "Limitation of Liability" survives the termination or expiration of the agreement formed pursuant to these Terms.
Security
of Information and Third Party Actions
While Models Connect takes security seriously, Models Connect makes no
warranty
or representation regarding the security of your information and data.
Models
Connect accepts no responsibility for the welfare of any user or for
the
actions of any user of the services of the website. We make limited
checks on
the companies but cannot guarantee its access is deemed only for
professionals.
Models Connect whilst we strive to ensure all information on the web site is correct we accept no liability for inaccuracy in any information displayed on our website. We shall use all resources and our reasonable skill to ensure that we supply correct information.
Information
Updates
Models Connect will use reasonable efforts to update your information
as soon
as practicable following your request. No information will be updated
if fees
are owing to Models Connect.
Content
Control
Models Connect reserves the right to withdraw, modify or delete
information at
any stage and without prior notice for any reason. If Models Connect
finds any
contribution by you to be offensive or improper, it may, in its sole
and
absolute discretion, change or remove that contribution, and/or suspend
or
terminate your use of Models Connect, without being liable for any
compensation
to you.
For the avoidance of doubt, and without limitation, Models Connect reserves the exclusive right to withdraw with or without notice, and for any or no reason, a user name or password that is deemed unsuitable by Models Connect, at Models Connect´s absolute discretion. In the event of a user name or password being withdrawn, Models Connect will issue you with an alternate user name and password provided you have acted in accordance with these Terms.
Information
Sent to Models Connect
You may, from time to time, be required to send information to Models
Connect
via the post (including but not limited to CVs, photographs etc).
Models
Connect will use reasonable endeavours to comply with any request you
make to
have items returned. You will be liable for all postage costs incurred
in
relation to a request for the return of information sent to Models
Connect.
Models Connect accepts no responsibility or liability for lost, damaged
or
destroyed information, or any damage, loss or expense suffered by you
in
relation to information sent to Models Connect.
Retention
of Applications
Models Connect reserves the right to retain any applications made to us
in
conjunction to services and promotions that may be offered or run from
time to
time, and to download the successful applicant´s information from
Models
Connect.
Payment Policy
There are 3 types of website membership, the Free one, the New Face one and the Professional one. If a New Face or Professional Membership is purchased there is a statutory 30 days cool-off period.
When any transaction is completed you have the right to the authorisation code to confirm the authenticity of the transaction and a receipt will be issued (where required) for your records.
Payment will only be deemed to have been made upon receipt of the funds in Models Connect´s bank account.
